Image Delivery, Copyright, and Licensing Notice

The images provided to you (the “Bearer”) in this Final Gallery have been fully retouched to the standards and brand that represent K Setterfield Photography (KS) and are being provided in High Resolution JPG format. KS hereby grants a License for Image Use under the terms stated herein. 

NOTE: Senior sessions: Images in your initial Proofing Gallery are STRICTLY PROHIBITED for use and are EXCLUDED from this License. ONLY purchased favorites are authorized for use, UNLESS your proofs have been purchased la carte, or were included in your package. Family and Couple sessions will receive all session photos with a print release on all images. However, only the retouched favorites will be authorized for use on social media.

Copyright and Licensing Notice

Bearer is hereby granted permission by KS for any reasonable personal use, including but not limited to making unlimited prints up to 16x20, (larger files may be requested on a per image basis) copying, emailing, web, and social media publishing. 

Bearer MUST use the high resolution Favorites downloaded via your Final Gallery for all posting, sharing, and printing. Even if you purchased the proofs or these were included in your package. ONLY the FAVORITES are authorized for social media posts. “Screen Shots” taken from your gallery are prohibited for use as they will result in a significant loss in image quality.

All delivered images are the artistic work of K Setterfield Photography, and encompass the brand, editing style, aesthetic quality and standard of K Setterfield Photography, provided in high resolution JPG format. Favorites will be retouched to the aesthetic standard and discretion of K Setterfield Photography. Retouching requests that reach beyond this standard may made available for an additional fee, or in cases where these request reach outside the standard, aesthetic preference, or ability of K Setterfield Photography, the request(s) may be denied. Modifications or alterations to the image(s), including Photoshop, other editing programs, Instagram, filters, etc. are strictly prohibited (with exception to cropping), by anyone other than K Setterfield Photography, unless at the studio’s discretion, they are outsourced to another professional editor. Under no circumstances will RAW images be provided, as they have not undergone the aforementioned artistic works.

Bearer agrees that he/she is not authorized for use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, resale of any nature, competition entry, etc, without the express written consent of K Setterfield Photography. 

While K Setterfield Photography’s practice is to keep the images on file for as long as possible, the Bearer’s receipt of this Final Gallery releases KS from any liability due to loss or damage of the images, and also releases KS from any obligation to maintain copies of any digital file, image, or photograph.

KS retains the right to use and publish images taken at your photography session including, but not limited to social media posts, web site, publishing entries/contests, studio displays, advertisement, editorial, and educational use, as authorized by the Bearer in the booking contract/model release.  

KS retains all copyrights to the images and derivative works thereof, per USC Title 17 (US Copyright Law), with no exceptions.
